Telecoms win immunity in wiretapping case, US court approves separate suit against the government

Looks like a case of good news-bad news for the Electronic Frontier Foundation in its fight against warrantless wiretapping. A US appeals court upheld a 2008 ruling, granting telecoms such as AT&T, Verizon and Sprint immunity for cooperating with the government in its surveillance activities. Still, Judge Margaret McKeown of the 9th US Circuit Court of Appeals insists that immunity only applies to telecoms, not the government, and that "the federal courts remain a forum to consider the constitutionality of the wiretapping scheme and other claims." Indeed, while the 9th Circuit upheld immunity for telecoms, it also gave the go-ahead for a separate suit against the NSA, former president George W. Bush, senior members of the Bush administration and President Obama for using AT&T's network to conduct "an unprecedented suspicionless general search," according to the filing. The court's decision to allow this suit to proceed marks a reversal of an earlier ruling, in which a lower court said the plaintiffs did not have legal standing to pursue the case.

Question: What's the Best Way to Celebrate Chinese New Year?

I am a big fan of feng shui and would like to celebrate Chinese New Year the right way. What is the best way to celebrate the Chinese New Year apart from having all the feng shui cures for the year?

Answer: First, congratulations on being a fan of feng shui. When you do your best to apply feng shui in your home, office and garden (or even in your car!); you know you can expect beautiful results in the quality of your everyday life. Feng shui is all about creating strong auspicious energy that attracts the best possible things into your life.

The Chinese New Year, also called the Lunar New Year, is one of the biggest celebrations in Chinese culture. It is a long celebration that lasts for 15 days. Because it depends on the moon cycle - Chinese New Year is on the first New Moon of the year - it comes on a different day each year and is considered to be the beginning of Spring.

Each year, as you probably know, has a specific Chinese zodiac animal, as well as a feng shui element associated with it. This determines the quality of energy in the New Year. For the traditional feng shui practitioners and enthusiasts it is also the time to adjust the annual feng shui cures, you are correct. Find out all about the annual stars, both beneficial feng shui stars, as well as the challenging ones for the current year and adjust the feng shui cures in your home decor several days before the Chinese New Year.

How can you best celebrate the Chinese New Year? It is always helpful to clean your home thoroughly, as well as use some space clearing to assure the feng shui energy in your home is clear and fresh. Be sure to do all the cleaning before the New Year's Day and refrain from cleaning in the first few days of the New Year, as this is considered bad luck.

Traditionally, here are the main elements of the Chinese New Year celebration:

  • HOME DECOR. After thoroughly cleansing the home, Chinese people will decorate it with auspicious red color decor items carrying golden inscriptions with the symbols of Happiness, Longevity, Prosperity, etc. Various flowers, such as Chrysanthemum, Lucky Bamboo, Plum Blossoms and others are used in the Chinese New Year home decor according to the specific meaning of each flower.

You will also see the mystic knot symbol used in numerous decor items, as well as images of many ancient gods venerated in Chinese culture, such as Guan Yu, the God of War and Justice, the Jade Emperor, as well as the very popular Kitchen God.

Basically, it is about creating clean and harmonious energy in your home in order to invite all the blessings of the New Year. Most Chinese people will also wear new clothes for the New Year celebration to symbolize the beginning of fresh energy. Many will also wear clothing in specific colors to win the favors of the ruling animal of the New Year.

How do you know which colors to wear this year? Look up:

    1. The feng shui element of the year, and then
    2. Choose the corresponding color. It's easy!

  • FOOD. The big dinner is sure an important part of this beautiful celebration, and there is a variety of traditional dishes that are prepared specifically for the Chinese New Year. Many of these dishes are served because of their meaning and association with specific energies, as well as on specific days of this long celebration.

For example "fish" in Cantonese sounds like "abundance", so there is always a fish dish at the Chinese New Year celebration. The uncut noodles symbolize long life, while the many sweet dishes are expressions of hope for sweetness in the New Year. You can look up the recipes for some of the most popular Chinese New Year dishes, such as:

The mandarin oranges are a must at the Chinese New Year table because they are a symbol of good luck, also called golden luck.
  • SOCIAL CUSTOMS. The morning after the New Year's day many traditional red envelopes with a bit of money in them are given to children and friends. This symbolises a helping hand from the older generation to the younger one, as well as wishes for prosperity and financial well-being. Small gifts are also exchanged between family members and friends.

You might be familiar with the lion dance, which is often performed during the Chinese New Year in both businesses, as well as some homes. The meaning of the lion dance is to evict and neutralize all negative energy from the previous year. The firecrackers during this celebration have the same purpose of evicting the evil spirits.

Traditionally, the Chinese New Year celebration lasts for 15 days with the festival of Lanterns being the culmination of this big holiday. This is the day when numerous candles are lit on the streets of Chinese communities to symbolize the coming of a fresh new light of the New Year. The beautiful sight of many red paper lanterns with a gentle flickering of fire in them is a welcoming symbol of the hopes and wishes for a beneficial New Year.

As you see, the Chinese New Year is a very beautiful celebration rooted in centuries of traditions with very specific symbolic meaning. You can either use the Chinese symbolism of the elements that most appeal to you, or create your own way of celebrating and welcoming the energy of a New Year.

What matters the most is that you genuinely celebrate a New Year, be it in a traditional Chinese way or not. Being genuine and open always wins the favors of Gods!

Scott Dudinskie's most memorable game of 2011: Danville vs. Lake-Lehman state baseball

I was a "no-hit, all-field" shortstop long before I knew there was such a thing.

After five years of Little League, I'd have bet my bike "three-and-out" was a baseball phrase coined for my at-bats.

Ted Williams literally wrote the book on hitting, but I didn't need him to tell me the most difficult thing to do in sports is hit a round ball with a round bat squarely. So tough, you'll often hear, the best fail seven out of every 10 times they try.

So I've always appreciated those who can do it consistently -- at any level of the game.

Barry Bonds did it so well he was intentionally walked a record 120 times in 2004 (while collecting 135 hits); the opposition figured it more prudent to give him a base than risk the home run king taking four with one swing. That's like a banker gladly handing out $100 bills to anyone with a rap sheet, but sometimes it makes sense.

You can take precautions with a great hitter, like a thief, or risk losing everything.

Danville trailed Lake-Lehman 5-1 in the middle of their first-round state playoff game the first week of June. It was a tough spot for the Ironmen, who had won their final three regular-season games over four days just to qualify for the district tournament they won.

However, pairs of errors in the first and fifth innings had them down four runs to a team they'd beaten 6-2 during that stretch of must-win games.

A brief aside: How many times have you done the math, trying to determine whether your team's big boppers will come to the plate again for one more shot?

Danville sluggers Anthony Renz and Cody Cooper each figured to bat once more, most likely in the sixth but maybe the fifth if the Ironmen could get a couple baserunners.

They came out of an impromptu team meeting in front of their dugout sticks blazing. Adam Creasy looped a one-out Texas Leaguer, and Andrew Andreychik followed with a laser to the wall in left-center field. Then Jeff Ross, who had a bad hack at an 0-2 curve his previous at-bat, went down to get an 0-2 bender and roped it into the left-field corner to make it 5-3. The scene was set for Renz and Cooper, who finished the season with more than 50 RBIs between them.

Renz popped out to shallow right field with a runner at third. No pressure, Cody.

A brief aside: How many times have you thought, A hit would be great but, man, how big would a homer be here?

Cooper blasted a made-to-order bomb to left-center that scattered birds beyond the Bowman Field wall and tied the score.

"Unbelievable clutch hitting," Danville coach Devin Knorr said later, a spot-on yet understated description.

Cooper's homer tied the game, plus it gave the Ironmen a decent chance to back to the middle of the order in the seventh.

They did, and Renz came to the plate with two outs and a man at second. He knocked the first pitch he saw to shallow right-center, a clean single off the bat, for the game-winning run.

Sure, there will always be more Mighty Caseys than Coopers and Renzes in those situations. That's what sets apart those magical, storybook endings.

A brief aside: How often have you thought to yourself, Wow, how lucky am I to have been here?

US seals $3.48B missiles, technology sale to UAE

(AP) ? The United States has reached a deal to sell $3.48 billion worth of missiles and related technology to the United Arab Emirates, a close Mideast ally, as part of a massive buildup of defense technology among friendly Mideast nations near Iran.

Pentagon spokesman George Little announced the Christmas Day sale on Friday night. He said the U.S. and U.A.E. have a strong defense relationship and are both interested in "a secure and stable" Persian Gulf region.

The deal includes 96 missiles, along with supporting technology and training support that Little says will bolster the nation's missile defense capacity.

The deal includes a contract with Lockheed Martin to produce the highly sophisticated Terminal High Altitude Area Defense, or THAAD, weapon system for the U.A.E.

Tom McGrath, vice president and program manager for Lockheed Martin's THAAD program in Dallas, said in a statement it was the first foreign military sale of the THAAD system.

THAAD interceptors are produced at Lockheed Martin's Pike County Facility in Troy, Alabama. The launchers and fire control units are produced at the company's Camden, Arkansas, facility.

Wary of Iran, the U.S. has been building up missile defenses of its allies, including a $1.7 billion deal to upgrade Saudi Arabia's Patriot missiles and the sale of 209 Patriot missiles to Kuwait, valued at about $900 million.

On Thursday, the Obama administration announced the sale of $30 billion worth of F-15SA fighter jets to Saudi Arabia.

Under the fighter jet agreement, the U.S. will send Saudi Arabia 84 new fighter jets and upgrades for 70 more. Production of the aircraft, which will be manufactured by Boeing Co., will support 50,000 jobs and have a $3.5 billion annual economic impact in the U.S.

All the sales are part of a larger U.S. effort to realign its defense policies in the Persian Gulf to keep Iran in check.

The announcement came as U.S. officials weighed a fresh threat from Tehran, which warned this week it could disrupt traffic through the Strait of Hormuz, a vital Persian Gulf oil transport route, if Washington levies new sanctions targeting Iran's crude exports.

Under Secretary of State for Political Affairs Wendy Sherman, the third-ranking U.S. diplomat, will travel to Saudi Arabia and the U.A.E. next week to discuss "ongoing developments" in the region with senior officials of the two nations, the State Department said Friday.

In 2012, Obama to press ahead without Congress (AP)

HONOLULU ? Leaving behind a year of bruising legislative battles, President Barack Obama enters his fourth year in office having calculated that he no longer needs Congress to promote his agenda and may even benefit in his re-election campaign if lawmakers accomplish little in 2012.

Absent any major policy pushes, much of the year will focus on winning a second term. The president will keep up a robust domestic travel schedule and aggressive campaign fundraising and use executive action to try to boost the economy.

Partisan, down-to-the-wire fights over allowing the nation to take on more debt and sharply reducing government spending defined 2011. In the new year, there are almost no must-do pieces of legislation facing the president and Congress.

The one exception is the looming debate on a full-year extension of a cut in the Social Security payroll tax rate from 6.2 percent to 4.2 percent. Democrats and Republicans are divided over how to put in place that extension.

The White House believes GOP lawmakers boxed themselves in during the pre-Christmas debate on the tax break and will be hard-pressed to back off their own assertions that it should continue through the end of 2012.

Once that debate is over, the White House says, Obama's political fate will no longer be tied to Washington.

"Now that he's sort of free from having to put out these fires, the president will have a larger playing field. If that includes Congress, all the better," said Josh Earnest, White House deputy press secretary. But, he added, "that's no longer a requirement."

Aides say the president will not turn his back on Congress completely in the new year. He is expected to once again push lawmakers to pass elements of his jobs bill that were blocked by Republicans last fall.

If those efforts fail, the White House says, Obama's re-election year will focus almost exclusively on executive action.

Earnest said Obama will come out with at least two or three directives per week, continuing the "We Can't Wait" campaign the administration began this fall, and try to define Republicans in Congress as gridlocked and dysfunctional.

Obama's election year retreat from legislative fights means this term will end without significant progress on two of his 2008 campaign promises, an immigration overhaul and closing the military prison for terrorist suspects at Guantanamo Bay, Cuba.

Presidential directives probably won't make a big dent in the nation's 8.6 percent unemployment rate or lead to significant improvements in the economy. That's the chief concern for many voters and the issue on which Republican candidates are most likely to criticize Obama.

In focusing on executive actions rather than ambitious legislation, the president risks appearing to be putting election-year strategy ahead of economic action at a time when millions of Americans are still out of work.

"Americans expect their elected leaders to work together to boost job creation, even in an election year," said Brendan Buck, a spokesman for House Speaker John Boehner, R-Ohio.

Still, Obama and his advisers are beginning 2012 with a renewed sense of confidence, buoyed by a series of polls that show the president's approval rating climbing as Congress becomes increasingly unpopular.

They believe his victory over Republicans in the payroll tax debate has boosted his credentials as a fighter for the middle class, a theme he will look to seize on in his Jan. 24 State of the Union address.

Obama's campaign-driven, domestic-travel schedule starts in Cleveland on Wednesday, the day after GOP presidential hopefuls square off in the Iowa caucuses. He will also keep up an aggressive re-election fundraising schedule, with events already lined up in Chicago on Jan. 11.

Campaign officials say Obama will fully engage in the re-election campaign once the Republicans pick their nominee. He will focus almost exclusively on campaigning after the late summer Democratic National Convention, barring unexpected developments at home or abroad.

Among the issues that could disrupt Obama's re-election plans: further economic turmoil in Europe, instability in North Korea following its leadership transition and threats from Iran.

The president's signature legislative accomplishment will also come under greater scrutiny in the new year, when a critical part of his health care overhaul is debated before the Supreme Court.

Obama's foreign travel next year will be limited mainly to the summits and international gatherings every U.S. president traditionally attends. He's expected to travel to South Korea in March for a nuclear security summit and to Colombia in April for the Summit of the Americas. He's also likely to visit Mexico in June for the G-20 economic summit.

Two other major international gatherings ? the NATO summit and the G-8 economic meeting ? will be held in Chicago, on home turf.
